1. Acceptance of These Terms

These Terms of Service ("Terms") form a binding agreement between you ("you" or "the User") and PROLINKLAB ACADEMY ("PROLINKLAB," "we," "us," or "our"). By accessing prolinklabacademy.com, purchasing a product, enrolling in a course, or joining our affiliate program, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use our Services.

2. About PROLINKLAB ACADEMY

PROLINKLAB ACADEMY is a bilingual digital entrepreneurship education platform offering courses, eBooks, coaching, and affiliate marketing training focused on practical, tested skills in income generation, health, and relationships for Anglophone and Francophone audiences, primarily across West and Central Africa. Our approach is practitioner-first and integrity-led: we teach what we have personally tested.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase products, enroll in courses, or join our affiliate program. By using the Services, you confirm that you meet this requirement.

4. Our Products and Services

PROLINKLAB ACADEMY offers digital products, including eBooks, video courses, coaching sessions, and affiliate marketing systems, delivered electronically. Product availability, pricing, and content may change at our discretion. We make reasonable efforts to describe our products accurately, but we do not guarantee that descriptions will always be error-free.

5. Purchases and Payment

• Prices are displayed in the currency shown at checkout and may be processed through Selar, Flutterwave, Paystack, Payoneer, mobile money, or other listed payment partners.
• Payment processing is handled by our third-party payment partners under their own terms and security standards. PROLINKLAB does not store your full card or mobile money credentials.
• You are responsible for any transaction fees, currency conversion charges, or taxes applied by your bank, mobile money operator, or payment processor.
• Some products are offered under a "Pay As You Want" model, where you choose the amount you pay, at your discretion.
• Access to purchased digital content is typically granted immediately after successful payment confirmation.

6. License to Use Our Content

Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the purchased content for your own individual learning and business purposes. You may not:

• Copy, reproduce, resell, sublicense, rent, or redistribute any course, eBook, or training material, in whole or in part.
• Share your login credentials, purchased files, or access links with anyone who has not purchased the product.
• Use our content to create a competing product or course without our prior written consent.
• Remove or alter any copyright, trademark, or attribution notice contained in our materials.

All course content, eBooks, branding, logos, and materials remain the intellectual property of PROLINKLAB ACADEMY or its licensors. Unauthorized use may result in termination of access and legal action.

7. Affiliate Program Terms

• Affiliates earn commissions on qualifying sales generated through their unique referral link or code, as specified in the applicable product's affiliate terms at the time of enrollment.
• Commission rates, cookie and attribution windows, and payout schedules are set for each product and may be updated with reasonable notice.
• Affiliates must not engage in spam, misleading advertising, false income claims, impersonation of PROLINKLAB, cookie stuffing, or any other deceptive promotional practice.
• Affiliates must clearly and conspicuously disclose their affiliate relationship wherever they promote PROLINKLAB products, consistent with generally accepted advertising disclosure standards. The disclosure should appear near the promotional content rather than being hidden in a footer.
• PROLINKLAB reserves the right to withhold or reverse commissions arising from fraudulent, self-referred, or policy-violating transactions, and to suspend or terminate an affiliate's participation for violating these Terms.
• The affiliate relationship does not create an employment, partnership, or agency relationship between the affiliate and PROLINKLAB.

8. Earnings and Results Disclaimer

PROLINKLAB ACADEMY teaches skills, strategies, and systems. We do not guarantee any specific income, number of sales, follower count, or business result. Any results referenced in our marketing, testimonials, or case studies reflect individual experiences and are not typical. Your results will depend on factors outside our control, including your effort, market conditions, prior experience, and time invested. Nothing on this website or in our products constitutes a promise or guarantee of income.

Where we reference the results of specific students or affiliates, we do so for illustrative purposes only. We do not claim that a typical purchaser will achieve similar results, and you should not rely on any individual example as an expectation of your own outcome.

9. User Conduct

When using our Services, you agree not to:

• Violate any applicable law, including Cameroon's Cybersecurity and Cybercrime Law and E-Commerce Law.
• Harass, threaten, or abuse other users, staff, or affiliates in our communities or support channels.
• Attempt to gain unauthorized access to our systems, other users' accounts, or non-public content.
• Use automated tools, including bots or scrapers, to access or extract content from our Services without permission.
• Upload or transmit viruses, malicious code, or content that infringes the rights of others.

10. User-Generated Content and Testimonials

If you submit testimonials, reviews, comments, or other content to us, you grant PROLINKLAB a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in our marketing and educational materials, including on our website, social media, and promotional content, unless you request otherwise in writing. You are responsible for ensuring that any content you submit does not infringe the rights of third parties.

11. Third-Party Links and Services

Our Services may reference or link to third-party platforms, such as Selar, WhatsApp, TikTok, affiliate programmes, or payment processors. We are not responsible for the content, policies, or practices of these third parties, and your use of their services is governed by their own terms.

12. Disclaimer of Warranties

The Services and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

13. Limitation of Liability

To the fullest extent permitted by applicable law, PROLINKLAB ACADEMY, its founder, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the specific product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless PROLINKLAB ACADEMY, its founder, staff, and affiliates from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your violation of these Terms, misuse of our content, or violation of any law or third-party right.

15. Termination

We may suspend or terminate your access to the Services, including course access or affiliate participation, at our discretion if you violate these Terms, engage in fraudulent activity, or misuse our content. You may stop using the Services at any time; however, amounts already paid remain subject to our Refund Policy.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Republic of Cameroon. Before pursuing formal legal action, both parties agree to try to resolve any dispute informally by contacting PROLINKLAB directly. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Yaoundé, Cameroon, without prejudice to any mandatory consumer protection rights available to you under the law of your country of residence.

17. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our products, practices, or applicable law. The "Effective Date" above indicates the most recent revision. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
